By accessing this website, contacting us about ShokIMU, purchasing hardware, or using the ShokIMU mobile app, you agree to these Terms of Service. If you do not agree, do not use our products or services.
2. About ShokIMU
ShokIMU is a Victorise product combining wireless motion sensor hardware and a companion mobile application. The app connects to BLE IMU modules, records ride sessions (including optional GPS), and provides analytics such as roughness estimates, vibration-band views, and ride-event summaries.
ShokIMU is under active development. Features, pricing, kit configurations, and availability may change before general release.
3. Not Professional or Safety Advice
ShokIMU provides informational estimates derived from motion sensors. It does not measure suspension stroke in millimeters, replace professional bicycle fitting or suspension tuning services, or guarantee any particular performance outcome.
You are solely responsible for safe installation of sensors and mounts, for riding within your ability, and for any setup changes you make based on app output. Never adjust your bike or riding line in ways that compromise safety while on trail.
4. Hardware
When you purchase ShokIMU hardware:
- You must follow included mounting and charging instructions.
- Improper mounting may damage equipment, affect data quality, or create a hazard. Mount securely and inspect before each ride.
- Hardware warranty terms, if any, will be provided with your kit or at purchase. Unless stated otherwise, warranty coverage is limited to manufacturing defects under normal use.
5. Mobile App License
Subject to these terms, Victorise grants you a personal, non-exclusive, non-transferable, revocable license to use the ShokIMU app on devices you own or control. You may not reverse engineer, decompile, redistribute, or resell the app except as permitted by law.
6. Acceptable Use
You agree not to:
- Use ShokIMU in violation of applicable laws or third-party rights.
- Attempt to interfere with app operation, BLE connections, or our infrastructure.
- Misrepresent ShokIMU output as certified test data or professional engineering results.
- Use the service to develop a competing product through unauthorized extraction of our software.
7. Your Data and Privacy
Your use of ShokIMU is also governed by our Privacy Policy, which describes how we handle inquiry information, app permissions, and ride data stored on your device.
8. Pre-Orders and Pricing
Prices shown on this website are target MSRP for the pre-launch program and may change. Pre-order or interest-list submissions do not constitute a binding purchase until you complete a confirmed order under separate purchase terms we provide at checkout.
9. Service Availability
We strive for reliable app and website operation but do not guarantee uninterrupted access. Maintenance, OS updates, Bluetooth limitations, or sensor battery state may affect recording. The app is provided on an "as is" and "as available" basis during development and after launch.
10. Intellectual Property
ShokIMU names, logos, website content, app software, and analytics methods are owned by Victorise or its licensors and protected by applicable intellectual property laws. You retain ownership of ride data you create; you grant us a limited license to process that data solely to provide the service.
11. Disclaimer of Warranties
To the fullest extent permitted by law, ShokIMU hardware and software are provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Victorise and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of ShokIMU hardware or software—even if we have been advised of the possibility of such damages.
Our total liability for any claim relating to ShokIMU shall not exceed the amount you paid for the hardware or app service giving rise to the claim in the twelve (12) months before the event, or one hundred U.S. dollars (USD $100) if no purchase was made.
13. Indemnification
You agree to indemnify and hold harmless Victorise, its officers, employees, and partners from claims arising out of your misuse of ShokIMU, unsafe mounting or riding, or violation of these terms.
14. Termination
We may suspend or terminate access to the app or website if you breach these terms. You may stop using ShokIMU at any time by uninstalling the app and discontinuing use of the hardware.
15. Governing Law
These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where mandatory local consumer protections apply.
16. Changes to These Terms
We may update these Terms of Service from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
